A Bright Future for Arbitration?

In this National Law Journal article, William Slate discusses some of the current challenges and possibilities for the field of ADR generally. Slate writes, “I’m often asked about ADR’s future. As in any field, future success depends upon a willingness to study the need to change, and to adapt to necessary changes with an open mind.”

He continues, “I believe ADR faces two immediate challenges: widely expressed concerns about the cost and expanding arbitration time lines, and public opinions by respected academics and others relying on anecdote and surmise to criticize — particularly arbitration — without accurate data….” Slate goes on to discuss a few sensible ways by which arbitrators might address these concerns.
