Judge Forces Apple Samsung Into Settlement Talks

Frustrated with the parties bickering, Judge Koh ordered the parties to make statements on their ability to utilized ADR methods. While the parties aren’t required to engage in a form of dispute resolution, if one parties refuses they appear to be “less than construction.” Monday’s court filing said, “As directed by the Court, Apple and Samsung are both willing to participate in a Magistrate Judge Settlement Conference with Judge Spero as mediator.”

Interesting to see the common misunderstanding here that equates a judge-led settlement conference with mediation. A settlement conference is NOT a mediation, and in California it is not covered by the mediation confidentiality provisions set forth in the CA Evidence Code.
