One couple on the edge of filing divorce proceedings gave it a try: &#8220;No solution appeared in sight after the first half-a-dozen sessions but by the eighth, it had become clear there was no real dispute apart from ego clashes. The mediator talked to the couple individually and jointly. The differences gradually narrowed down.&#8221;

Possibly my favourite soundbite of this morning’s sessions was this comment from the floor when delegates were discussing standards and good practice. Of all the discussion around how prescriptive or flexible mediation training could or should be, this phrase seems to neatly summarise one of the big dilemmas facing anyone attempting to develop an international standard of training provision.

The current medical debt crisis in the United States is overburdening bankruptcy court.[1] Debtors are filing bankruptcy because they are unable to pay their medical debts.[2]  An insurance mandate will not provide enough assistance for those with insurance and without insurance to eliminate all medical debt and avoid bankruptcy.

The term mediation is in many ways vague.  There are different approaches used by mediators: &#8220;Mediation could be evaluative, facilitative, or transformative.&#8221;  There are also different types of mediation depending on the stage of litigation: &#8220;There are differences between pre-filing and post-filing mediations.&#8221; There are different requirements for mediation: &#8220;Is the mediation voluntary or mandatory, as it is when parties file a Request for Order Regarding Child Custody and/or Visitation agreement.&#8221;
