Mediation Bill to be Gazetted

A mediation bill in Hong Kong will be gazetted on Friday November 18, 2011. In keeping with the flexibility of the mediation process, the Bill hopes to “promote, encourage and facilitate the resolution of disputes by mediation” while still protecting the confidentiality of all mediation communications by creating a legislative framework for mediation.

As mediation becomes more and more popular around the world, Hong Kong hopes that this mediation legislation will fortify its status as an international dispute resolution centre. A spokesperson from the Department of Justice said, “The Bill is necessary to provide legal certainty regarding confidentiality of mediation communications and admissibility of mediation communications in evidence.”
