Feds want employee’s laptop in B-1 visa case
March 28, 2011
Employee filed a lawsuit against employer, Infosys Technologies, for alleged harassment when the employee declined to assist the company in getting B-1 business visas when he believed that an H-1B visa was required. Infosys first had the case moved to federal court. Now the parties are battling over the work computer.
Amidst the battle over the company laptop, Infosys seeks to use the arbitration agreement in the contract to compel arbitration. Arbitration is the ideal venue to keep this dispute out of the public eye; however, concerns arise regarding accountability of companies especially in the employment context.
