Washington State May Implement “Co-Mediations”

A recent increase in large payouts from public records disputes has some in the Washington state government considering using “co-mediation,” with one mediator representing the requesting party and another representing the government agency. The idea, being considered by state Attorney General Rob McKenna, is a novel attempt to circumvent a fundamental inability of many parties to agree on one mediator.
