Lawyers and Mediation: What’s the right direction for resolution?

There is no question that ADR is useful for solving disputes, but are lawyers and mediators entering into negotiations with the right mindset? There remains, however, a great deal of debate about different perspectives and ‘moves’ that mediators use. There is continuing confusion about what should happen and what actions by the mediator are useful.
