Is Ireland Mediation Act a Shift in the Right Direction?

Although Ireland already recognizes mediation in the Irish High and Commercial courts and in the Rules of the Superior Courts, the Mediation Act 2017 goes into effect as of January 1, 2018. The Act “places on a statutory footing the obligation to consider mediation and requires litigants to confirm to the Courts that they have considered mediation.” The Act even authorizes the imposition of costs sanctions (for failure to unreasonably engage in mediation).
