Recently, the UK Judiciary has sanctioned even a successful party if its failure to mediate was unreasonable. While the Judiciary in the UK has embraced mediation, the government has moved slower, only recently expanding Small Claims Mediation Services and the National Mediation Hotline.

As the UK puts pressure on parties to settle, concerns and fears that mediation is supplanting litigation arise. However, with the limited resources of many courts, mediation may be creating true access to justice.
