Massey Energy Co. and Appalachian Plaintiffs Try Mediation Again

Plaintiffs from across Appalachia and Virginia-based Massey Energy Co. are “summoned” to mediation for a second time by a three-judge panel in a trial that it set for August. The medical monitoring lawsuit involves allegations that energy-giant poisoned hundred of southern West Virginia wells with coal slurry.

Although Massey did not comment on the future mediation, Plaintiffs welcome a fair settlement “after so many years of fighting.” While the last mediation session required that all plaintiffs attend, it will be interesting to see how the landscape of this mediation will be different without all 700 plaintiffs in attendance.
