Mediation Plan “Could Add to Divorce Stress”

Divorcing parties in the UK are now required to attend mediation prior to a divorce court proceeding. While the law has potential to help resolve cases amicably and keep those cases out of court, it remains to be seen how “easy it will be for a warring couple to enter into a successful mediation” which typically require goodwill and co-operation.

The UK’s once-generous legal aid program has faced a lot of cuts this year, and this law is no doubt another way to cut costs for the legal aid budget. While there are concerns about requiring mediation, there is also great potential that this “child-focused” mediation process will help families make the transition in a non-adversarial environment.
