Texas Supreme Court Evaluates Child Custody Agreements

The Texas Supreme Court must determine the validity of a custody agreement reached in mediation. On the one hand, state law encourages the use of mediators which produce “out-of-court settlements that are cheaper, faster and less stressful for children — by giving judges little leeway to interfere afterward.” On the other hand, overturning the agreement “risks upending the entire mediation system and all its benefits for families across Texas” says Lawyer Scott Rothenberg.
